John Moore Services, Inc. has filed an anti-trust action in Harris County District Court. According to the petition, the parties have been engaged in related legal battles the first of which was filed by in federal court for trademark infringement BBB Houston against John Moore, a former member of Houston BBB who, after some controversy, switched its membership to Bryan-College Station BBB. In a second related case, John Moore filed causes of action for defamation and related claims. BBB Houston filed a motion to dismiss based on the Texas Anti-SLAPP statute. The trial court denied this motion, BBB Houston appealed and the appellate court reversed and remanded. John Moore has filed a petition for review with the Texas Supreme Court which is still pending.
This latest suit filed against BBB Houston and affiliated individuals some of whom have sat on the board of BBB Houston and own home repair related businesses, accuses the BBB of violating Texas anti-trust laws by squeezing out competitors such as Yelp, Angie’s list, and have engaged in anti-competitive activities in order to monopolize the home repair market. The petition also includes fraud, conspiracy and breach of contract-related causes of action.
